Fin Design + Effects ("Fin", "we", "us", "our") is an Australian visual effects and design studio. We are committed to protecting your privacy and handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
This policy explains what personal information we collect, how we collect, hold, use and disclose it, and how you can access or correct your information or make a complaint. It applies to personal information we handle through our website (findesign.com.au), by email and phone, and in the course of running our business, including working with clients, suppliers and job applicants.
Where we handle personal information of individuals located in the European Union or the United Kingdom, the additional information in section 12 also applies.
The personal information we collect depends on your relationship with us:
Enquiries and business contacts. If you contact us about a project or general enquiry, we may collect your name, email address, phone number, company or organisation, job title, and the contents of your correspondence.
Clients, suppliers and production contacts. In the course of delivering our services we collect contact and billing details of client and supplier representatives, agency and production personnel, and other people involved in a project — such as names, roles, work contact details, and information contained in contracts, schedules, call sheets and project correspondence. Production material we receive (footage, plates, scripts and other assets) may incidentally contain personal information, including images of performers and crew; we handle this material under our confidentiality obligations to our clients.
Job applicants and freelancers. If you apply for a role or register your interest in working with us, we collect the information you provide, such as your name and contact details, CV/resume, showreel and portfolio, employment history, qualifications, work rights information, referee details, and information obtained from your referees. We may also collect publicly available professional information (for example, your IMDb, LinkedIn or portfolio site).
Website visitors. When you visit our website we collect limited information through cookies and similar technologies, described in section 5.
We do not generally collect sensitive information (such as health information or racial or ethnic origin) and will only do so with your consent, or where otherwise permitted by law.
You can deal with us anonymously or under a pseudonym for general enquiries where it is lawful and practicable to do so; however, we usually need your real identity to respond to project enquiries, engage you for work, or process a job application.

We work with international clients and studio partners, and some of our service providers store data overseas. Personal information may be disclosed to recipients located in the United States, Canada, the United Kingdom, the European Union and New Zealand, including cloud and software providers with global infrastructure.
Where we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with the APPs, such as through contractual protections, unless an exception under the Privacy Act applies.
We hold personal information in electronic systems (including secure cloud services) and, to a limited extent, in hard copy at our studios. We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure, including access controls, authentication (including multi-factor authentication on key systems), encryption in transit, network security measures, and the industry-standard security practices required of a studio that regularly handles confidential pre-release production material.
If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme.
We keep personal information only for as long as it is needed for the purposes described in this policy or as required by law (for example, tax and employment record-keeping requirements). Job application material is retained so we can consider you for future roles, unless you ask us to delete it sooner. When personal information is no longer required, we take reasonable steps to destroy or de-identify it.
We do not use computer programs to make decisions that could significantly affect your rights or interests without human involvement. If this changes, we will update this policy to explain the kinds of decisions involved and the information used to make them.
You may request access to the personal information we hold about you, or ask us to correct it, by contacting us at privacy@findesign.com.au. We will respond within a reasonable period (usually within 30 days). We do not charge for making a request, though in limited cases we may charge our reasonable costs of giving access. If we refuse access or correction, we will give you written reasons and information about how to complain.
If you believe we have breached the APPs, please contact us in writing using the details in section 13. We will acknowledge your complaint promptly, investigate it, and respond to you, usually within 30 days. If you are not satisfied with our response, you can complain to the OAIC:

Controller. Fin Design + Effects is the controller of your personal data. Contact details are in section 13.
Legal bases. We process personal data on the following legal bases: performance of a contract or steps taken at your request before entering a contract (for example, project engagements and job applications); our legitimate interests (for example, responding to enquiries, business development, and securing our systems), balanced against your rights; consent, where we ask for it (which you may withdraw at any time); and compliance with legal obligations.
International transfers. We are located in Australia, so your personal data will be transferred to and processed in Australia, and may be transferred to the other countries listed in section 7. Where required, we rely on appropriate safeguards such as standard contractual clauses.
Your rights. Subject to conditions and exemptions under the GDPR/UK GDPR, you have rights to access, rectify or erase your personal data, restrict or object to its processing, data portability, and to withdraw consent. You can exercise these rights by contacting us. You also have the right to lodge a complaint with your local supervisory authority — in the UK, the Information Commissioner's Office (ico.org.uk); in the EU, the data protection authority in your member state.
Retention. We retain personal data as described in section 9.
